Akshat Maheshwari is an Advocate specializing in Insolvency Law, currently serving at the Chambers of Eshna Kumar since October 2023. With a comprehensive legal background and a sharp focus on insolvency and bankruptcy matters, Akshat has been pivotal in shaping legal strategies and providing legal solutions to a diverse clientele.
In his role, Akshat has been involved in negotiating, vetting, and drafting a variety of legal documents, including applications, petitions, schemes of arrangements under the Insolvency and Bankruptcy Code, 2016 and the Companies Act, 2013. He has also prepared detailed legal opinions on significant issues such as special dividends and the functioning of the Committee of Creditors (COC). His transactional experience extends to real estate, where he conducted due diligence and prepared comprehensive reports.
Akshat’s expertise further extends to court management and advisory services, preparation of necessary documentation, and coordination with legal teams and clients to ensure smooth processes. He has regularly appeared before various courts and tribunals, including the National Company Law Tribunal (NCLT) and the National Company Law Appellate Tribunal (NCLAT). His advisory role involves offering clients strategic support on critical legal matters, business opportunities and regulatory affairs.
Before joining the Chambers of Eshna Kumar, Akshat served as an Associate at MVAC Miglani Varma and Co. from February to July 2023. During this time, he honed his skills in drafting and vetting a wide range of agreements, including employment contracts, intellectual property sale/licensing agreements and service agreements. His role also involved advising clients on navigating complex employee-related disputes and negotiations, actively engaging in conflict resolution strategies and mitigating legal risks. Akshat was responsible for preparing and filing court documents such as applications, replies, rejoinders and notices under various provisions of the Code of Civil Procedure, 1908.
In addition to his transactional and advisory experience, Akshat has conducted in-depth research on exceptions to limitation of liability clauses in contracts. He has been involved in drafting and reviewing transactional documentation, including investment agreements, shareholders’ agreements, business transfer agreements, and non-disclosure and non-solicitation agreements, showcasing his versatility and thorough understanding of complex legal frameworks.
